1. The activities, classes and workshops provided by Elite Fight Club involve risks and dangers of serious health-related issues, serious bodily injury, including permanent disability, paralysis and death (the “Risks”). There may be other risks either not known to me or not readily foreseeable at this time (the “Unknown Risks”), and I ACCEPT AND ASSUME THE RISKS AND THE UNKNOWN RISKS AND ALL RESPONSIBILITIES FOR ANY LOSSES, COSTS, AND DAMAGES WHATSOEVER that I may suffer and/or incur as a result of attending or participating in any of the Elite Fight Club classes, training sessions, and workshops.

2. I acknowledge and understand that, even with proper instruction, supervision, and adherence to safety guidelines, there remains a risk of injury associated with participation in the Activities offered by Elite Fight Club. I accept that such risk is inherent and unavoidable in martial arts and combat sports training. I represent and warrant that I am physically and medically fit to participate in the Activities and that it is my sole responsibility to consult with a qualified physician or other licensed healthcare professional regarding my ability to safely participate prior to engaging in any activities at Elite Fight Club. I further acknowledge that Elite Fight Club does not provide medical advice and relies on my representations regarding my fitness to participate.

3. I hereby represent, warrant, and attest that I do not have any physical, psychological, medical, or emotional condition, impairment, injury, or illness that would prevent or limit my ability to safely participate in any of the activities, classes, programs, or training sessions offered by Elite Fight Club. I further acknowledge that I am responsible for immediately discontinuing participation and notifying Elite Fight Club staff should my condition change in any manner that could affect my ability to safely participate.

4. I, on behalf of myself and my heirs, executors, administrators, legal representatives, successors, and assigns, HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE Elite Fight Club, its owners, administrators, directors, officers, shareholders, volunteers, instructors, coaches, employees, contractors, agents, and representatives (collectively, the “Released Parties”) from any and all liabilities, claims, demands, causes of action, losses, damages, costs, and expenses of any kind whatsoever, whether known or unknown, foreseen or unforeseen, arising out of or in any way related to my attendance at, or participation in, any activities, classes, training sessions, programs, workshops, or events provided by Elite Fight Club. This release includes, without limitation, any claims arising from or alleged to arise from the negligence, breach of duty, or fault of the Released Parties, to the fullest extent permitted by law.

5. I, on behalf of myself and my heirs, executors, administrators, legal representatives, successors, and assigns, HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE Elite Fight Club, its owners, administrators, directors, officers, shareholders, volunteers, instructors, coaches, employees, contractors, agents, and representatives (collectively, the “Released Parties”) from any and all liabilities, claims, demands, causes of action, losses, damages, costs, and expenses of any kind whatsoever, whether known or unknown, foreseen or unforeseen, arising out of, resulting from, or in any way connected with my attendance at, or participation in, any activities, classes, training sessions, programs, workshops, or events provided by Elite Fight Club. This release specifically includes, without limitation, any claims arising from, or alleged to arise from, the negligence, breach of duty, or fault of the Released Parties, to the fullest extent permitted by law.

6. I further acknowledge, understand, and agree that by signing this Agreement, I fully, voluntarily, and irrevocably waive and relinquish any and all legal rights, claims, or causes of action that I may have, now or in the future, against Elite Fight Club and the Released Parties, including but not limited to claims arising from negligence, breach of duty, or any other act or omission, to the fullest extent permitted by law.

7. I further agree that in the event I commence any claim, action, or proceeding against Elite Fight Club or any of the Released Parties, this Agreement may be pleaded as a complete bar and defense by Elite Fight Club and its administrators, directors, officers, volunteers, instructors, employees, and staff, as well as by any person, firm, or corporation who might have a claim for contribution or indemnity from Elite Fight Club. I also agree to indemnify and hold harmless Elite Fight Club and the Released Parties from any and all claims, causes of action, resulting losses, damages, costs, and legal fees incurred as a result of defending against such claim, action, or proceeding.

8. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, and acknowledge that I have given up substantial legal rights by signing it. I have signed this Agreement freely, voluntarily, and without any inducement, assurance, or undue influence of any kind. I intend this Agreement to constitute a complete and unconditional assumption of the risks associated with the activities, classes, programs, training sessions, workshops, and events offered by Elite Fight Club, and a waiver and release of all liabilities of the Released Parties. I further agree that if any provision of this Agreement is found to be invalid, unenforceable, or void, the remaining provisions shall remain in full force and effect, and such invalidity shall not affect the enforceability of the remainder of the Agreement.

9. By checking this box, I consent to the use of my electronic signature in place of an original, handwritten signature on paper for this Agreement and any related documents. I acknowledge that I have the right to request a paper copy instead of using an electronic signature, and by providing my consent, I waive that right. I understand that after providing consent, I may, upon written request, obtain a paper copy of any electronically signed record at no cost, and that no special hardware or software is required to view such a copy. My consent to use an electronic signature will remain in effect until I notify Elite Fight Club in writing that I no longer wish to use an electronic signature. There is no penalty for withdrawing this consent. I also acknowledge that it is my responsibility to ensure that Elite Fight Club has a current and accurate email address to contact me regarding any changes or updates to this Agreement.
